Terms of Service

Brian Minton Notary (“we,” “us,” or “our”) provides professional notary and signing services in compliance with Indiana law. By booking or receiving services, you (“Client”) agree to the following Terms of Service.

1. Scope of Services

Brian Minton Notary offers the following services throughout Indiana:

A. Mobile Notary Services
– In-person notarizations performed at your chosen location.
– Available by appointment only within the defined service area (Hendricks, Boone, Hamilton, Morgan, and Marion Counties).
– Includes standard notarial acts such as acknowledgments, jurats, oaths/affirmations, and copy certifications.
– Each notarized signature is billed per Indiana’s statutory fee schedule, plus a travel/convenience fee.

B. Remote Online Notarization (RON)
– Secure online notarizations conducted through a state-approved RON platform.
– ID verification, credential analysis, and session recording are required by law.
– Clients must have a valid government-issued photo ID and a stable internet connection.
– Fees include document verification, digital notarization, and secure document delivery.

C. Loan Signing Services
– Professional signing agent services for mortgage, refinance, HELOC, and real estate closing documents.
– Travel within designated counties is included; additional mileage may apply for distant locations.
– All loan signings include document review, signing oversight, notarization of required pages, and return handling.

D. Estate Planning & Legal Document Services
– Specialized support for attorneys and estate planners for Wills, Trusts, Power of Attorney, and related documents.
– Witness coordination is available upon request.
– Multiple-document packages may be bundled at discounted rates.

E. Business & Specialty Notary Services
– Notarizations for small business, employment, and corporate documents.
– Includes Affidavits, Operating Agreements, and vendor contracts.
– Optional monthly business packages available for recurring needs.

2. Scheduling & Appointments

All appointments require prior scheduling through the official booking page, by phone, or by email.
Same-day or rush appointments are subject to availability and may incur an additional fee.
Clients must confirm the type of service requested before the appointment.

3. Payment Terms

Payment is due at the time of service unless otherwise arranged in writing.
Accepted forms of payment include credit/debit card, PayPal, Square, or approved invoicing for business clients.
Returned payments or chargebacks may result in suspension of future services.

4. Cancellation & Rescheduling Policy

To ensure professional time management and fairness to all clients:

A. Standard Notary Appointments
– Cancellations made 12 or more hours before the scheduled time: No fee.
– Cancellations made within 12 hours of the appointment: $25 cancellation fee.
– No-shows without notice: Full service fee charged.

B. Loan Signings
– Cancellations within 24 hours of a scheduled loan signing: $50 cancellation fee.
– Rescheduling within 12 hours of the original appointment: $35 rescheduling fee.
– No-show or incomplete signing due to client or document issues: Full signing fee applies.
– If the title company cancels the signing or lender after travel has begun, a $50 trip fee will be invoiced.

C. Remote Online Notarization
– Cancellations made before the session begins: No charge.
– If the client fails ID verification or does not join the session within 10 minutes, a $15 failed session fee will apply.

5. Travel Policy

A flat fee applies within a 10-mile radius of Plainfield, IN (office location).
Travel beyond 10 miles is billed at $1.00 per mile round-trip.
Rush or after-hours appointments (evenings, weekends, or holidays) are subject to an additional $25–$50 surcharge, depending on circumstances.

6. Client Responsibilities

Clients agree to:
– Present valid, unexpired government-issued photo identification.
– Ensure all documents are complete and ready for notarization.
– Understand that notaries cannot provide legal advice or draft documents.
– Notify the notary of any errors, delays, or rescheduling requests as soon as possible.

7. Confidentiality & Privacy

All client documents and identification information are handled with strict confidentiality and used solely for the purpose of notarization.
Brian Minton Notary complies with Indiana’s notarial recordkeeping and data protection requirements, including secure document storage and encryption for RON transactions.

8. Limitation of Liability

While every effort is made to ensure accurate and lawful notarizations, Brian Minton Notary’s liability is limited to the cost of the notarial service rendered.
We are not responsible for document errors outside of the notarization section, nor for delays or rejections caused by third parties (e.g., lenders, title companies, or courier services).

9. Governing Law

These Terms of Service are governed by and interpreted under the laws of the State of Indiana, without regard to its conflict of law provisions.
Any disputes arising from these terms shall be handled within Hendricks County, Indiana.
